2. Warranty Coverage
All Rodney Jane Racing and Auscar alloy wheels and associated
products and accessories supplied by Bob Jane T-Marts are
manufactured in compliance with Australian Standard AS1638. The
finish and structural warranty
referred to in paragraph 1 shall apply as follows:
- The warranty will only be applicable to the original purchaser
of the alloy wheels and associated products and accessories. The
warranty is unable to be assigned to a future purchaser of the
customer's vehicle and entitlement to rely upon the terms and
conditions of this warranty do not automatically vest in the
purchaser of a customer's vehicle upon such purchase being
completed;
- In addition to the compulsory consumer guarantees provided by
the ACL, Bob Jane T-Marts warrants that all Rodney Jane Racing and
Auscar alloy wheels and associated products and accessories are
free from structural defect and shall remain free
from structural defect for the lifetime of those products, subject
to the specific exclusion specified in paragraphs 5 and 6 of this
warranty;
- In addition to the compulsory consumer guarantees provided by
the ACL, Bob Jane T-Marts warrants that all Rodney Jane Racing and
Auscar alloy wheels and associated products and accessories do not
contain any faults or defects in the finish of
those products and shall not contain any such faults or defects
for a period of 12 months after the date of
purchase. Subject to the specific exclusions specified in
paragraphs 5 and 6 of this warranty;
- The finish warranty in section 2C above
will apply to
- the breakdown of any protective surface on all Rodney Jane
Racing and Auscar alloy wheels, including the breakdown of any
painted, clear coated and/or chrome surfaces on those wheels;
- such problems as the peeling of paint from the surface of any
Rodney Jane Racing and Auscar alloy wheels arising out of poor
surface preparation of the wheels or corrosion of the painted,
clear-lacquered or chrome protective finish on those wheels. These
problems have a propensity to lead to degradation of the surface
finish leaving the alloy exposed to the elements and therefore
subject to damage.
- any accessories to the Rodney Jane Racing and Auscar alloy
wheels which form part of the aesthetics of those wheels, such as
centrecaps, decals, false ornamental rivets and bolts. In the event
that these accessories break (without abuse) or become dislodged
from the wheels as a result of poor quality or poor workmanship,
these parts will be replaced without any charge to the
customer.
- Rodney Jane Racing and Auscar wheels which are unable to be
balanced properly, but only in circumstances where evidence has
been produced by the customer as to the balancing problem
immediately after the wheels have been fitted to the customer's
vehicle.

3. Inspection Standard of New Alloy Wheels
Subsequent to manufacture and completion of all Rodney Jane
Racing and Auscar alloy wheels supplied by Bob Jane T-Marts, and
prior to supply to customers, Bob Jane T-Marts conducts an
inspection of the said wheels in order to confirm that the finish
is of an acceptable standard. This inspection is carried into
effect by Bob Jane T-Marts by visually inspecting the alloy wheels
in correct lighting at a distance approximating 1 metre. In
conducting inspections of the alloy wheels in this manner, it is
possible that certain imperfections in the finish of the said
wheels may not be noticed by representatives of Bob Jane T-Marts
Wheel Division and these defects may manifest themselves at a later
stage.

4. Maintenance of New Alloy Wheels
To ensure that Rodney Jane Racing and Auscar alloy wheels
maintain their high quality and long life, it is imperative that
the customer understands the importance of maintaining the alloy
wheels properly. If the above mentioned alloy wheels are not
appropriately maintained during the course of their use, they may
sustain unnecessary damage. In the event that damage is sustained
to an alloy wheel as a consequence of a customer's failure to
follow appropriate maintenance procedures, that customer may, in
some circumstances, be prohibited from relying upon the terms and
conditions of this warranty. Bob Jane T-Marts provides the
following guidelines for appropriate maintenance of all Rodney Jane
Racing and Auscar alloy wheels:
- Once alloy wheels have been purchased and fitted to the
customer's vehicle, it is important that the customer re-tension
the wheel nuts/bolts after the vehicle has travelled 200
kilometres. This is extremely important as the wheel nuts/bolts can
be loosened slightly during the first 200 kilometres which may
result in unnecessary damage or wear and tear to the alloy wheels
and a reduction in driving safety;
- Subsequent to the first 200 kilometres, the customer should
carry out a periodic monthly inspection of the wheel nuts/bolts on
all alloy wheels to ensure that they have not become loose;
- It is important that new alloy wheels are cleaned on a regular
basis to maintain a painted, clear coated or chrome protective
finish and to ensure that the finish does not become affected by
corrosive materials. It is suggested that the alloy wheels should
be appropriately washed at least once a fortnight, however, if a
customer's vehicle is used on a particularly extensive or intensive
basis, it may be necessary for the wheels to be washed on a more
regular basis to avoid damage to the finish.
- It is suggested that the alloy wheels should be washed
thoroughly with water and a gentle soap product. As some soaps and
detergents are harsh, the customer should investigate the
ingredients of any such soap or detergent to ensure they are not
likely to harm the painted, clear coated or chrome protective
finish.
- If a customer is unable to ascertain the most suitable products
to be used in washing the alloy wheels, the customer should contact
their nearest Bob Jane T-Marts outlet, whose staff will be happy to
assist in any queries which the customer may have.
- Chrome alloy wheels require a more regular maintenance regime
in order to maintain the appearance and quality of the finish.
Chrome alloy wheels should be washed at least once a week and then
polished on a regular basis to protect against corrosion. It is
suggested that, in order to provide effective protection, chrome
alloy wheels should be polished at least once a month.
- By not regularly washing the alloy wheels, the protective
finishes may degrade rapidly. It is especially important that the
customer undertakes a regular cleaning ritual in circumstances
where the customer's vehicle is being used in such a manner that it
may come into contact with corrosive materials, chemicals,
excessive dirt or ocean air, as these materials are more likely to
corrode the protective surface if allowed to remain on that surface
for an extended period of time.
- If appropriate maintenance procedures are not followed by the
customer, the customer's reliance upon the terms and conditions of
this warranty will be adversely affected and Bob Jane T-Marts
reserves the right to refuse repairs or replacement of the wheels
or associated products and accessories in circumstances where any
damage, defect or fault has arisen as a consequence of the
customer's failure to maintain.
- Care should be taken in parking your vehicle alongside concrete
kerbs or similar objects, since scraping wheels along a harsh
surface can scratch and damage the finish of the Wheels. Such care
is especially important for the passenger side when parking your
vehicle. Damage caused by careless parking alongside kerbs
and similar objects is considered not to be reasonable treatment of
your Wheels and resulting damage will not be covered by your
Warranty - see section 5B below.

5. Reasons for Refusal of a Claim for Warranty
Bob Jane T-Marts will refuse or deny a claim in accordance with
the terms and conditions of this warranty in the following
circumstances:
- Any apparent fault, damage or defect in the finish of the
Rodney Jane Racing and Auscar alloy wheel which is not observable
by adopting the method of inspection referred to in paragraph 3,
that is, which is not noticeable by observation of the wheel in
correct lighting at a distance of 1 metre. In the event that, at
the time of original inspection of the above mentioned alloy
wheels, the wheel does contain a minor imperfection in its finish
which is not observable by adoption of the previously mentioned
inspection method, a customer is entitled to rely upon the terms
and conditions of this warranty in circumstances where that minor
imperfection causes any damage, fault or defect in the finish of
the alloy wheel, which is observable by adoption of the said
inspection method, within the relevant 12 month warranty
period.
- The damage, defect or fault in the wheel, or the protective
finish of the wheel, has been caused, or, in the opinion of Bob
Jane T-Marts, reasonably appears to have been caused, by the
purposeful or inadvertent act of the customer or any third party,
including, but not limited to, damage caused to the alloy wheel by
collision with another vehicle, collision with roadside kerbs,
collision with pot holes or by the wheel being struck or otherwise
dealt with in an inappropriate manner.
- It is determined that the alloy wheels have not been
appropriately maintained by the customer such that any damage,
defect or fault in the wheel is consequential upon that failure to
maintain. An assessment as to whether or not the wheels have been
appropriately maintained will be effected by the Virtual Wheels
Technical Office;
- Any centrecaps, decals or false ornamental rivets or bolts
which are missing from the alloy wheel in circumstances where those
parts have been stolen or otherwise removed by the customer or a
third party.
- Damage to, or loss of centrecaps, decals, false ornamental
rivets or bolts or other such accessories which form part of the
aesthetics of the alloy wheel caused by the purposeful or
inadvertent act of the customer or a third party.
- Where, upon inspection, there is evidence of paint chipping
around the centrebore area or stud holes on the alloy wheel as this
damage may have been incurred as a result of the actions of
balancing machine equipment (bore area paint damage) or fitting
braces/rattle guns (stud hold paint damage) during the course of
the fitting process. Any claims where there is evidence of paint
chipping around the centrebore area or stud holes will be required
to be directed to the Bob Jane T-Marts outlet responsible for
fitting the alloy wheels to the customer's vehicle.
- The claim by the customer has been lodged subsequent to the
lapse of the 12 month warranty period in relation to damage,
defects or faults in the protective finish. Even if damage, faults
or defects are discovered in the protective finish on the alloy
wheels within the 12 month period subsequent to purchase, it is
incumbent upon the customer to provide notice of that damage and
the customer's reliance upon the terms and conditions of this
warranty to Bob Jane T-Marts prior to the expiration of the
relevant 12 month period. If the problem manifests itself on the
last day before the expiration of the 12 month warranty period, the
customer must contact Bob Jane T-Marts immediately to provide
notice of the relevant defect or damage, otherwise the customer's
entitlement to rely upon the terms and conditions of this warrant
will be lost.
- Where the relevant alloy wheels have been purchased from Bob
Jane T-Marts in circumstances where they were heavily discounted or
otherwise identified as being a "special" purchase. In this
respect, sometimes wheels are sold at greatly reduced prices as
they are obsolete or discontinued lines. These products will not be
covered by the terms and conditions of this warranty. Quite often
such clearance products are no longer available from suppliers or
distributors. In such cases, a claim is unable to be made against
Bob Jane T-Marts Wheel Division due to the unavailability of
replacement alloy wheels or the associated parts and accessories in
the event that those wheels or parts and accessories are lost or
damaged. In such cases, Bob Jane T-Marts will, in an effort to
maintain good customer relations, negotiate with the relevant
customer to reduce the price of wheels and/or parts and accessories
already provided or to provide the customer with special
consideration with respect to future purchases.
- Where the customer has not provided Bob Jane T-Marts with
notification of a problem with the wheels being unable to be
balanced properly, prior to the customer's vehicle being used after
fitting. Once the vehicle has been used subsequent to fitting, any
problems with the balancing of the alloy wheels must be brought to
the notice of the Bob Jane T-Marts outlet where the wheels were
fitted. Bob Jane T-Marts shall, at all material times, be the sole
and final arbiter of all claims made pursuant to the terms and
conditions of this warranty.

6. Warranty/Claims Procedure
In the event that a customer wishes to make a claim for a Rodney
Jane Racing Wheel or Auscar Wheel upon the terms and conditions of
this warranty, the following procedure must be adhered to in all
respects. Any failure to comply with the procedure set out
hereunder may operate to prevent the customer from relying upon the
terms and conditions of this warranty.
- As soon as the customer discovers:
- any defects, damage or fault in the structure of the above
mentioned alloy wheels; or
- any fault, defect or damage to the protective finish on the
above mentioned alloy wheels; or
- any defect, fault or damage to the associated products and
accessories; or
- that any items such as centrecaps, decals, false ornamental
rivets or bolts have become dislodged from the alloy wheel and are
missing, the customer must immediately contact Bob Jane T-Marts so
as to arrange a time for an inspection of the said wheels and/or
associated products and accessories. Alternatively, the customer
must attend upon any Bob Jane T-Marts outlet immediately upon
discovering the fault, defect, damage or loss so as to arrange for
an inspection to be conducted. If the customer fails to bring any
defect, damage, loss or fault to the timely attention of Bob Jane
T-Marts, Bob Jane T-Marts may deny or modify the customer's claim
pursuant to the terms and conditions of this warranty in
circumstances where the customer's failure to report the damage,
defect, loss or fault in a timely fashion has resulted in
consequential damage.
- The customer must, when attending upon the Bob Jane T-Marts
outlet, produce a copy of the original invoice generated by Bob
Jane T-Marts when providing the relevant alloy wheel and/or
associated products and accessories. A copy of the original invoice
must be produced and no claim will be honoured by Bob Jane T-Marts
without same.
- Any problem with any Rodney Jane Racing or Auscar alloy wheel
or associated products and accessories should be discussed with
representatives of the Bob Jane T-Marts outlet who will then
conduct a simple assessment of the relevant product. This
representative may then contact the Bob Jane Corporation Wheel
Division for further guidance, if necessary.
- In some circumstances, the affected wheel or wheels may need to
be returned to the Bob Jane Wheel Division for further inspection
and assessment. The customer will be required to meet the payment
of any expenses associated with transporting the relevant wheels to
and from the Bob Jane Wheel Division, however, in the event that
the relevant product is found to be faulty or defective, any
freight charge deemed to be payable for the transport of the said
product will be paid by Bob Jane T-Marts Wheel Division and not the
customer.
- In most circumstances, if any wheels or associated products and
accessories require lengthy assessment and inspection, Bob Jane
T-Marts will provide the customer with a replacement wheel or part
until the assessment by Bob Jane T-Marts has been completed and a
determination has been made as to whether or not the customer is
entitled to rely upon the terms and conditions of this warranty in
the circumstances.
- In the event that any wheel or associated product or accessory
requires transportation to the Bob Jane Corporation Wheel Division
for inspection and assessment, it is envisaged that the relevant
product will not be returned to the Bob Jane T-Marts outlet for a
period approximating seven (7) working days from the date upon
which the said product was received at the Bob Jane Corporation
Wheel Division.
- Once an inspection or assessment of the relevant product as
been effected by representatives of a Bob Jane T-Marts outlet or by
representatives of the Bob Jane Corporation Wheel Division, a
determination will be made by Bob Jane T-Marts as to whether or not
the customer is entitled to rely upon the terms and conditions of
this warranty.
- If Bob Jane T-Marts determines that the relevant damage, loss,
fault or defect is subject to the terms and conditions of this
warranty, Bob Jane T-Marts will make the appropriate arrangements
with the customer to repair the relevant product or to provide a
replacement product, if necessary.
